  • It makes unwarranted (and crazy) claims.

  • It violates packaging safety rules.

  • It warns that it could change your genome.

  • It talks about sharks and aquariums.

Mermaid Tears ™ is proof of a real problem.

  • We were able to have it listed on DailyMed for less than $500 without any human oversight. Misuse of this system has led to the legitimization of unlawful products like Regener-Eyes.

  • OTC eye drops like Ezricare Artificial Tears, Mermaid Tears, and Regener-Eyes can be sold without their manufacturing facilities being inspected or their packaging validated for safety. Human oversight before Ezricare Artificial Tears went on the market would have prevented three deaths and numerous cases of blindness.

  • We easily listed Mermaid Tears for sale on Walmart and Amazon.

  • Many unscrupulous companies have chosen to sell their eye drops without notifying the FDA—meaning there are an unknown number of untraceable eye drops on eCommerce market.

  • Our current OTC framework relies entirely on manufacturers doing the right thing. This is no longer enough when practically anyone can list eye drops for sale on the internet.

  • The open eye drop market is being treated as a clinical trial — we may not know about future tragedies until enough adverse event reports lead to a recall.
